The following Terms of Service (ToS) and Acceptable Use Policy (A.U.P.) will govern all accounts, services, and amenities provided by, or through Imladris Services S.L. as a Reseller of Third Party services.

GENERAL

 

Imladris Services S.L (hereafter referenced as "The Provider") provides Virtual Private Networking services, and other Internet-related services under various Brand names. As a provider of internet web hosting and other internet services, The Provider offers its clients, and their customers and users, the means to disseminate public, private, commercial, and non-commercial information.

The Provider respects the fact that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, The Provider reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, The Provider has developed this Acceptable Use Policy (AUP), which supplements and explains certain terms of each customer's respective service agreement. This AUP is intended as a guide to the customer's rights and obligations when utilizing The Providers services.

This AUP will be revised from time to time. A customer's use of The Providers services after changes to the AUP are posted on The Providers web sites will constitute the customer's acceptance of any new or additional terms of the AUP.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet to disseminate information to others.

It must be kept in mind that The Provider does not review, edit, censor, or take responsibility for any information its clients may create. When clients place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they place on The Providers network may be carried to a large number of people, including both clients and non-clients of The Provider, clients' postings to the Internet may affect other clients and may harm The Providers goodwill, business reputation, and operations.

 

CANCELING AND REFUNDS

You may cancel and receive a refund if you do so within 15 days after purchase, if the service has not been used in that time. Unless there is a technical issue with the services making Subscriber unable to use it properly, (verified by The Provider staff that none of the provided methods to use the services are possible from your Internet connection), no refunds will be given later than 15 days after purchase. If we find a charge has been forcefully refunded or charged back for no valid reason, after you have been using the service, or had your account disabled due to abuse (see below), you will be in violation of this agreement. Chargebacks or forced refunds from your account will also cause you to be listed in an online fraud database. If you have created a recurring subscription you may cancel it at any time. To do so, please use the cancellation facilities povided by the payment system used for the subscription, or if unable to do that, please use the online support form. Please include your account username and password. Your account will then be cancelled at the end of your already paid subscription period. If you were never assigned a username and password, or have been unable to access the service due to an error on the part of The Provider you may either have the charge refunded or we will activate your account and compensate you (with extra time or a free account upgrade) for any lost time. We will not issue refunds for any other reason.

 

PROHIBITED ACTIVITIES

The Provider clients violate The Provider policy and the service agreement when the clients, their customers, affiliates, or subsidiaries engage in the following prohibited activities: 

    • Spamming
    • Intellectual Property Violations
    • Defamatory or Abusive Language
    • Forging of Headers
    • Illegal or Unauthorized Access to Other Computers or Networks
    • Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities
    • Facilitating a Violation of this AUP
    • Spamming Usenet Groups or Message Boards
    • Any Other Illegal Activities

 It is The Providers policy to terminate the privileges of customers who commit repeat violations of The Providers policy and service agreements.

Spamming is the sending unsolicited bulk and/or commercial messages over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward The Provider, but also because it can overload The Providers network and disrupt service to The Providers clients. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, The Provider has the discretion to determine from all of the evidence whether the e-mail recipients were from an "opt-in" e-mail list. Refer to our UCE/SPAM Policy for more information.

Intellectual Property Violations is the engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. The Provider is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement laws.

Defamatory or Abusive Language refers to the use of The Providers network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

Forging of Headers refers to the forging or misrepresenting of message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks is accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). This violation also includes any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities refers to the distributing of information regarding the creation of and sending of internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, it includes any activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

Facilitating a Violation of this AUP refers to advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.

Spamming Usenet Groups or Message Boards -  The Provider reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities refers to engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes. Other examples are fraudulently charging credit cards and pirating software.

Other Activities refer to any activity, including lawful ones, that The Provider determines to be harmful to its clients, operations, reputation, goodwill, or customer relations.

The responsibility for avoiding the harmful activities just described rests primarily with the client. The Provider will not, in normal practice, monitor the communications of its clients to ensure that they comply with The Provider policy or applicable law. When The Provider becomes aware of harmful activities, however, it may take any action to stop the harmful activity, including but not limited to, removing information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or other actions The Provider deems appropriate.

 

PRIVACY POLICY

ItsVPN.com respects your privacy. We will collect and use information through our web site and products only in the ways disclosed in this statement. This statement applies solely to information collected at The Providers web site, or through The Provider merchant providers.

Personal information collected by The Provider

We collect personal information that is provided by site users. "Personal Information" includes your name, address, telephone number, e-mail address, and IP address. Personal Information is collected when you establish an account with us, place an order on the site, participate in a contest, sweepstakes or on-line survey, or when you communicate with any of our departments such as customer service, sales or technical services through the site, telephone, mail or fax.

How we use information

The Provider will use personally identifiable information collected through our web site to contact users regarding products and services offered by us. We will not rent, sell or otherwise disclose your personal information to unrelated third parties without your consent, except as stated in this privacy policy.

Service Providers: We may employ other companies or individuals to provide certain services to or on behalf of us such as server management, security audit, analyzing customer lists and data, or performing marketing or consulting services. These third parties ("Service Providers") will only have access to the information needed to perform these limited functions on our behalf and are required to provide your personal information with at least the same level of protection and security as we use on the site. Such service providers are prohibited from using your personal information for any purpose other than that for which such party was engaged by us and/or as stated in this privacy policy.

Fraud Prevention: We use a third party service provider, PayPal Inc., to assist us with preventing and monitoring fraudulent activity on the site. If you would like more information concerning PayPal's privacy practices, go to www.paypal.com. In the event that your purchase is denied based on a risk assessment provided to us, you may contact us to dispute the information contained in such risk assessment.

Logging Policy

We do not spy on our users and we don't monitor their Internet usage. If we have reasonable grounds to suspect that an end user is involved in criminal activities, we reserve the right to notify law enforcement agencies.
